• ”Website” shall mean and include “https://igurufy.com, mobile application and any successor website or mobile application of the Company or any of its affiliates;
• “Applicable Law” means in respect of a person, any statute, law, regulation, ordinance, rule, judgment, decree, by-law, approval from the concerned authority, government resolution, order, directive, guideline, policy, requirement, or other governmental restriction or any similar form of decision, or determination, or any interpretation or adjudication having the force of law of any of the foregoing, by any concerned authority or other requirements of any governmental or regulatory authority, to which such person is subject;
• “Guru “or “Seller” Account shall mean an electronic account opened by the Seller or Guru with the Platform to offer Services through the Website;
• “Customer Account” shall mean an electronic account opened by the User with the Website to take the subscription of any service from the website;
• “Membership Fee” means the membership fee paid by Guru for participation in the Membership Plan, paid directly by customers to the Website.
• “Membership Plan” shall means the plan available on the Website through which members can avail various services available on the Website.

III. INTERPRETATION

• All references to singular include plural and vice versa and the word “includes” should be construed as “without limitation”.
• Words importing any gender shall include all the other genders.
• Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.
• All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or effect the meaning or interpretation of the terms of this Agreement.

www.igurufy.com is an online website to provide quality services tailored to the public need along with allowing reviewers/users to rate/review on Guros regarding past experiences with them on either a personal or business engagement. Under this website, the Gurus work as Seller in order to sell their services online. The Customer/reviewer can purchase the services of the Seller/Guru through this website by subscribing various membership plan available on the website/ via one time cost fee’s as well. This website also provide the facility to the Customer to give reviews and ratings about the services of the Guru/Seller through the website on both current and past experiences encountered with the Guru.

 

The Services are offered to the Users through various modes which may include issue of coupons and vouchers that can be redeemed for various Services.

VI. REGISTRATION INFORMATION

If you access this website anonymously, you will not be required to create a user name. But, in order to access certain Resources, you may be required to provide specific information and to create a user ID or sign up via your Instagram username and password to establish an account.

You agree that the information you provide in connection with establishing any account is accurate and that you will keep your information up-to-date. You are responsible for the security of all of your user names, passwords and registration information (such as unique account identifiers or historical billing information), and you are solely responsible for any use (authorized or not) of your accounts. Our staff reviews all content submitted for posting. Staff can revise provided information and content at their option. Any provided content that comprises, but is not limited to the following, will be amended or rejected. If recurring violations happen, we reserves the right to cancel user access to website without advanced notice.

IX. SUBSCRIPTION

• Any subscription through Membership plan by the Customer for taking any services from this Website is between Customer and Website. Customer agree to take particular care when providing us with its details and warrant that these details are accurate and complete at the time of ordering.
• SUBSCRIPTION CHARGES: It is agreed by the user that for becoming Customer:
  • Customer shall pay membership fee to the Company as per the Membership plan of the Company.
• Subscription Payment: Preferred method of payment is PayPal, Credit and Debit cards are accepted via PayPal merchant services. Accepted cards are: Visa / Delta / Electron / MasterCard / Eurocard / Maestro/ American Express Debit cards are accepted if they have a Visa or MasterCard logo.
• When registering with this Website you may be required to provide a username and password. You must ensure that you keep these details secure and do not provide this information to a third party.
• We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website
• Any order for subscription to Member plan that you place with us is subject to acceptance by us. When you place your order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your order and subscription details.
• Customers have the option to include a comment, and rate Guru/Seller service. They also have the right to not leave a review or rating at all. This is their choice.
• We may refuse or be unable to process your order/subscription if:
  • You credit card or paypal account does not give authorization for the payment of purchase price.
  • You do not meet the eligibility to order criteria set out above.
• You are entitled to a Membership Fee Refund as per our Refund Policy.

• You shall not trail, bully or harass another person;
• You may not buy or sell any Users accounts

• You shall not misrepresent or personate any person or entity for any false or illegal purpose;
• You shall not use any virus, hacking tool for interfering in the operation of the website or data and files of the website;
• You will not any device, scraper or any automated thing to access the website for any mean without taking permission.

By become Guru/Seller, the Guru accepts and agrees to be bound by these terms in full.

Representations and Warranties

The Guru/Seller expressly warrants and represents that

• Seller or Guru will need to upload their identification and selfie photo in order to verify their pages.
• Guru/Seller shall not provide any Service that is ambiguous or misleading or likely to deceive or mislead or that is defamatory or indecent or which otherwise offends the ethical and moral standards of society. Further, the Service does not infringes a copyright, trademark or otherwise infringes any intellectual property rights; that breaches any provision of any statute, regulation, bye law or any other rule or law, as may be applicable in force from time to time;
• The Service of Guru/Seller will not give rise to any claim or action against www.igurufy.com or any of its employees, directors, representatives etc.

• The Service provided by the Guru/Seller through the Website should be provided in good faith.
• Under no circumstances, we (www.igurufy.com) shall be responsible in respect of any loss or damage, costs of claims, actions or proceedings, including the expenses incurred for defending the same arising against them from the offering of Service by the Guru/Seller in accordance with the terms and conditions contained herein.

ENTIRE AGREEMENT

GOVERNING LAW AND JUDICIAL RECOURSE

The courts of the State of California shall have exclusive jurisdiction over any dispute arising from use of the Website.

 FORCE MAJEURE

We will have no liability to you, your users, or any third party for any failure us to perform its obligations under these Terms in the event that such non-performance arises as a result of the occurrence of an event beyond the reasonable control of us, including, without limitation, an act of war or terrorism, natural disaster, failure of electricity supply, riot, civil disorder, or civil commotion or other force majeure event.

HOSTING SERVICES

We have entered into arrangements with one or more third parties for hosting services that are essential to the Services incorporated within the Services and without which the Services could not be provided to you.

ASSIGNMENT

The Company shall have the right to assign/transfer these presents to any third party including its holding company, subsidiaries, affiliates, associates and group companies, without any consent of the User.
